Man Shoots Two Teenage Intruders: Was It Murder or Self-Defense?

Jury will decide whether force was necessary and reasonable in deaths of popular high school students.

Little Falls, Minn. – The trial of a 65-year-old man who shot and killed two teenage intruders is underway and stirring a debate about self-defense and the use of lethal force.

Byron Smith has been charged with first degree murder in the Thanksgiving 2012 deaths of Nick Brady, 17, Haile Kifer, 16, ABC News reported. Brady and Kifer were shot to death after breaking into Smith's home.

Smith shot both teens multiple times, including walking up and shooting Brady in the face after he was already down, ABC reported. Smith told police: "I want him dead."

Smith's defense attorney argued that Smith was in fear and had anxiety over several break-ins. Prosecutors contend he planned to murder the two teens and waited in the basement with a bottle of water, a book, energy bars and two guns, ABC reported.

ABC News reported that Smith waited a day before asking a neighbor to call police.

@grumpyold...one can only hope that someday, you will be the victim of a particularly brutal home invasion, perhaps at the hands of two young people such as these. If you are fortunate enough to survive, we hope to read your comments on the Patch.

Ok Grumpy.......LOL! You are so full of yourself its actually funny. You thought you knew everything about the kid wearing the t shirt too. Then you announced to everyone there your leaving that thread and u come here to offer your infinite wisdom. There's now a bigger douche here than Dan...... GREAT! My guess is your a guy with no life. Your sitting in a room full of dirty old newspapers who cruises the internet looking to offer his take on anything. I agree with one thing. This guy will appeal. And now I'm telling u he will get a new trial. These punks stole his guns, and a lot of very personal items. Two summers before he befriended these same 2 when they were looking to do yard work. They stole from him then too. He didn't have em back. They started tormenting him then breaking in. These 2 got what they had coming. I live in Florida and home invasions are common. If they had come in my house again after stealing 2 of my guns I would shoot first and ask questions later. And No Grumpy, I would find no joy in it. When u play with fire sometimes u get burned. There's folks here in Florida who would have done a lot to these 2 before shooting them. They would be welcoming death. Now your last post you said you were going to keep quiet. You won't...... Cuz that's what you douchy know it all do. Pssst! We are not impressed......

They found stolen items in Brady's home from previous break ins and he had a picture of 2 guns on his Facebook page. If the jury can't know that then the recording should be disallowed. Let's have a fair trial
